Moreover, the Terms comprise the legal power that authorizes Shopeyship to act on behalf of the Member in particular situations.

Acceptance of the Terms:
By submitting your Personal Information to us, you authorize us to use it for the operation, maintenance, and provision of features and functionality of the platform. We may collect and utilize your Personal Information for various purposes, including the activation of your account, or the use of the services provided by shopeyship.com. By accessing or using this website and its content, you accept and agree to be legally bound by the Terms and Conditions and our Privacy Policy.

Shopeyship.com prohibits any illegal activity by its Members. Any charges incurred by shopeyship.com in connection with the enforcement of the law against a Member or potential Member will be the financial responsibility of that Member or potential Member. Please refer to the Indemnification section for further details.
Membership will commence on the day we receive your application. You represent and warrant that you are responsible for complying with all applicable export and import control laws and regulations in the order and receipt of merchandise and mail under these Terms.
Eligibility to use the website:
The website is provided by the proprietor and is only available to entities and individuals who have the legal capacity to enter into a binding agreement under the applicable law and for commercial use purposes only. Personal use of the website is not permitted. If you or your proposed use of the website do not meet the earlier-mentioned requirements, you are not authorized to use the website.
In addition, if you are considered a “consumer” as per the CPA (Consumer Protection Act), the privilege granted to you to use the website will be automatically terminated, and the Proprietor and its affiliates have the right to treat all transactions entered into by you through the website as void and non-binding on them, at your sole cost and risk.

Members must use the website for lawful purposes only and comply with all applicable laws and regulations. Evidence of illegal use of the website may be provided to law enforcement authorities.

- Members must not attempt to circumvent or subvert system or network security mechanisms or probe the security of any system, network, or account associated with or used in conjunction with the website.
- Members must not authorize or permit anyone else to access and/or use their account registration information or access, visit, and/or use the website by us of their account/profile and/or registration information or impersonate, imitate, or pretend to be somebody else.
- Members must not use the website in any manner that could disable, overburden, damage, or impair the website or interfere with any other person’s use of the website, including their ability to engage in real time activities through the website.
- Members must not use any robot, spider, or other automatic devices, process, or means to access the website for any purpose, including monitoring or copying any of the material on the website.

- Members must not copy, reproduce, modify, edit, crop, alter, revise, adapt, enhance, translate, reformat, remix, rearrange, resize, create derivative works of, move, remove, delete, or erase any copyright, trademark, or other proprietary legends, symbols, marks, or notices on the website, or attempt to circumvent any mechanisms for preventing the unauthorized reproduction or distribution of content.

If you do, you grant Shopeyship.com a perpetual, worldwide, irrevocable, fully-paid-up, royalty-free, nonexclusive license to use, reproduce, copy, modify, publish, distribute, perform, display, and create derivate works from that information for any reason.

Terms of service:
Shopeyship.com will provide Members with a Locker number at the Shopeyship facility in India where they can receive mail ad merchandise for export. Shopeyship serves as the member’s agent for consolidation and export by receiving the member’s merchandise, sorting, packing, and consolidating it. Shopeyship.com arranges for export to the member’s specified local address through an unaffiliated service provider, which acts as the freight forwarder and/or carrier for the shipment. Shopeyship.com is not an indirect air carrier of the property but instead acts as an agent of the shipper aka members.
All packages received by Shopeyship.com will be opened by company representatives. Members are responsible for all import and export obligations in the country where the mail and packages will be sent. Members authorize Shopeyship.com as their agent to allow freight forwarders and/or carriers to conduct customs clearance and entry and to certify freight forwarders and/or carriers as the consignee solely to designate a customs broker to perform customs clearance and entry.
Members acknowledge the freight forwarders and/or carriers reserve the right to open and inspect every shipment tendered on behalf of Shopeyship members. Shopeyship advises members to insure goods are handed over for transportation according to the consignor insurance.
Shopeyship shall have a general lien over all the member’s consignments towards any dues payable to Shopeyship. No claim shall be entertained by Shopeyship for any loss or shortage/damage/bob-delivery/breakage/leakages/pilferage, etc. unless a written claim is lodged within 3 days from the date of shipment, subject to remarks on the proof of delivery of merchandise for any reason.

Compliance with laws:

Compliance with export and import laws:
i) The recipient of any items consolidated by Shopeyship.com is the end user of all merchandise and mail that the member has requested to be exported through a freight forwarder or carrier to the recipient’s address. In the case of reselling merchandise, the member can provide Shopeyship.com with information on the end users as requested.
ii) All merchandise and mail that the member requests to be consolidated by Shopeyship.com will be used in the country to which the member requests shipment.
iii) The member will not re-export the merchandise and mail it to a different destination.
iv) The member will not return to India or resell in or into India any food products or dietary supplements it receives through Shopeyship.com, and will ensure that any recipients of the food products or dietary supplements adhere to the same requirements.
v) Shopeyship has the right to request that the member or the recipient of an item sign documents confirming the end use or end user of any item exported through a freight forwarder or carrier by Shopeyship.com.
vi) If the member is a reseller, they agree to be bound by all terms and conditions of Shopeyship.com. The Shopeyship.com Terms & Conditions are subject to change at any time.
vii) The member shall not use, transfer, re-export, resell, or otherwise dispose of any items consolidated and/or exported using the services of Shopeyship.com to any destination, end-user, or for any end-use prohibited by the laws of India.
viii) By signing and returning this letter, the member agrees to comply with all relevant export laws of India and ensure that any names or addresses they add to their account and customers to whom they resell do not appear on an Indian Government denied party list.

Your Personal Information:
We will collect your Personal Information, which includes your name, contact details, and email address, as part of your use of the website and our interactions with you. We will only use your Personal Information with your consent to provide you with information about our products and services. Your Personal Information will be handled in compliance with applicable data protection laws, and we will maintain appropriate data security measures to prevent any loss or unauthorized access to your personal data. We may disclose your Personal Information to third parties who process it on our behalf. Prohibited and restricted items
Depending on your destination country, some products may require an import license, and additional documentation, or cause problems, and delays during the customs review of your shipment. The following list is a non-exhaustive example of items that fall under these restrictions:
i) Combustible/flammable items such as paints, oils, lighters, perfumes, and nail polish
ii) Pressurized cans like hair spray, shaving cream, and other spray cans
iii) Hazardous materials like matches, chemicals, and explosives
iv) Firearms, weaponry, and their parts, including guns, gun replicas, accessories, components, ammunition, knives, swords, compound bows, crossbows, discharge weapons, tooling, optical scopes, laser sights, night vision goggles, handcuffs, other restraints
v) Agricultural products like tobacco, plants, and seeds (restricted to some destinations)
vi) Perishable foods like refrigerated, frozen, fresh/raw fruits and vegetables, and other food items
vii) Animals and products made with animal skin, like furs
viii)Alcohol (limited quantities of table wine can be shipped through unaffiliated freight forwarders and carriers to some countries, except Muslim countries like Saudi Arabia)
ix) Cash, currency, money orders, cashiers’ checks, bank drafts, bearer bonds, collectible stamps and coins, jewelry, and precious stones
x) Lottery tickets and gambling devices
xi) Prescription and/or veterinary medication
xii) Pornography
xiii) Lock-picking devices
xiv) Government IDs and licenses or items that look similar to them, including uniforms and badges or patches that resemble official government issues
xv) Used computer equipment or electronic storage devices with software or data (solely the responsibility of the customer)
xvi) Items that require an export license under the EAR or are subject to the ITAR, except for eligible items under an approved export license exception
The customer is responsible for ensuring that they do not send prohibited items to Shopeyship.com. We reserve the right to return packages to the sender, provide packages and related information to government authorities, or dispose off packages (including selling forfeited items for charity). Fraud Prevention:
Shopeyship takes reasonable measures to prevent fraudulent use of the website. However, Shopeyship cannot be held liable for any loss or damage resulting from fraudulent use of the website by you or by third parties. If you suspect fraudulent activity related to your account, you must contact Shopeyship.com immediately, and Shopeyship.com will cancel the account.
The use of the website for multi-level marketing, pyramid schemes, receiving checks and/or money orders, or other business practices that are easily subject to abuse is strictly prohibited.
By using the website, you represent, warrant, and promise that all information you provide to Shopeyship.com is accurate and complies with all applicable local, state, and federal laws and regulations, including any information regarding the value or export classification of merchandise. You are solely responsible for such information and for maintaining all necessary records as required by law. Making false or fraudulent statements concerning such information may result in civil or criminal penalties imposed by the Indian government.

Members are required to use the website in strict accordance with all applicable laws, rulings, and regulations, and in a manner that does not harm the reputation or goodwill of the Proprietor. Members are prohibited from taking any action that may result in Shopeyship being found in violation of any applicable laws, rulings, or regulations.
Export control regulations:
Shopeyship and the website are situated in India, a country that may regulate the export of products and information. Members are required to comply with all applicable export restrictions and must not export or re-export any content (including any software or services) to countries or individuals prohibited under India or other relevant export control laws or regulations. If a member accesses and downloads any content (including software or services) or information, they are deemed to have represented that they are not in a country where such export is prohibited or are not individuals or entities to whom such export is prohibited.
The legality of shipment:
Members are solely responsible for complying with the laws of their local jurisdiction and any other relevant laws related to the import, export, or re-export of goods. It is the responsibility of the member to ensure that the proposed shipments are legal, including but not limited to ensuring that they comply with applicable sanctions or restrictive measures.
Customs:
The member is responsible for reimbursing Shopeyship for any customs-related duties, fees, and associated costs incurred by Shopeyship on behalf of the member concerning the consignment. This includes any duties, fees, and costs incurred during the customs duty clearance process. For this clause, “customs duty” refers to any duty or charge of any kind imposed in connection with the importation or exportation of a good, including any surtax or surcharge related to such importation or exportation.

These Terms do not constitute, nor shall they be construed as, an agreement between the parties for the provision of freight services. Shopeyship is not providing any freight services of any kind, nor shall Shopeyship be bound by, or liable under, any contract relating to freight services entered into by any other party.

Appointment of Shopeyship.com as Member’s agent:
By becoming a member, you give Shopeyship.com written authorization to act on your behalf as your lawful and true agent for the following specific purposes:
- Preparation of shipping documents, including Certificates of Origin
- Preparation of an airway bill or any other document necessary for exporting merchandise to you.
- Signing service agreements on your behalf and authorizing parties to such service agreements with the power of sub-delegation for completing all necessary documentation for clearance and delivery of all shipments subject to the agreements.
- Authorizing freight forwarders and/or carriers to conduct customs clearance and entry, and certifying them as the consignee for the sole purpose of designating a customs broker to perform customs clearance and entry.

Indemnification:
The member agrees to remain liable and indemnify, defend, and hold harmless Shopeyship.com and its shareholders, officers, directors, agents, employees, partners, and independent contractors, at all times from the date hereof, from any claims, awards, actions, liabilities, damages, losses (including consequential losses), judgments, fines, penalties, expenses, interest, and/or other costs (including attorney’s charges and court costs) arising from:
- Any negligent action or omission of Member or any of Member’s employees, contractors, agents, or any other person acting under Member’s supervision or control before, as of, or following the date hereof,
- Any inaccuracy or breach of any representation or warranty made by the member in these Terms or any other document or instrument executed or delivered by the member in connection with these Terms;
- Any breach or non-performance of any covenant or agreement made by Member in these Terms or any other document or instrument made by Member in connection with these Terms;
- All claims, losses, charges, and expenses incurred by Shopeyship due to any banned, restricted, or dangerous items entering into the network of Shopeyship due to any omission or commission of Member;
- Shopeyship.com’s preparation, determination, or execution of the documents or any other document necessary for transportation, including but not limited to preparing address information, routing, classification, licensing requirements, and listing the value of goods or the value for carriage, except for claims arising solely from the gross negligence or willful misconduct of Shopeyship.com;
- The member providing Shopeyship.com with any incomplete or false information; and
- The member’s failure to comply with the terms hereof or of any jurisdiction’s law applicable to the exportation or importation of such shipments.
The Member acknowledges that the above provisions are a material inducement for Shopeyship.com to enter into these Terms and the transactions contemplated hereby, and shall survive termination of these Terms.

Limitation of liability:
Under no circumstances will any of the Shopeyship parties be liable for any loss or damage caused by your reliance on information obtained through this website. It is your responsibility to evaluate the accuracy, completeness, or usefulness of this website. In no event shall any of the Shopeyship parties be liable for any direct, indirect, punitive, special, or consequential damages arising out of or relating to the website, the content, or this agreement, whether based on warranty, contract, tort, or any other legal theory.
In jurisdictions where the exclusion or limitation of liability for negligence, consequential, incidental, or other damages is not allowed, the liability of the Shopeyship parties is limited to the greatest extent permitted by law. Your sole remedy for dissatisfaction with this website is to stop using this website.
Please note that this provision is important and should be read carefully. By using this website, you agree to waive any claims against any of the Shopeyship parties that may arise from your use of this website.

Furthermore, the Shopeyship parties do not warrant that the website will be uninterrupted or error-free, that any specific information requested will be provided, or that the website or its server are or will be free of computer viruses or other harmful elements. As a user, you expressly agree that the entire risk as to the quality and performance of this website and the accuracy, completeness, or timeliness of the content is assumed solely by you.
None of the Shopeyship parties makes any representations, guarantees, endorsements, or warranties, express or implied, regarding this website, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose, title, and non-infringement of third-party rights. You understand and agree that any content, material, and/or data downloaded or otherwise obtained through the use of the website is used at your own risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of such content, data, and/or material.

Severability:
Using any of the prohibited methods or disregarding any of the Terms in these Terms and Conditions is solely at your own risk. In the event that any part of these Terms and Conditions is found to be invalid or unenforceable under applicable law, that particular provision will be considered replaced by a valid and enforceable provision that best reflects the intent of the original provision, while the remainder of the agreement will still be in effect and govern such use.

By using this website, you acknowledge and agree that no joint venture, partnership, employment, or agency relationship, except as explicitly stated in these Terms and Conditions, exists between you and Shopeyship.com due to your use of this website or these Terms.

Entire Agreement:
All terms and conditions related to this website and included in these Terms, and they represent the complete agreement between you and Shopeyship.com. Any previous or current electronic, oral, or written communication or proposal between you and Shopeyship.com with respect to this website is superseded by these Terms. Any perceived waiver of any breach of this Agreement shall not be considered as a waiver of any subsequent breach.

Conflict of Laws:
The provisions in these Terms and any conflicts that may arise shall be governed by the applicable laws and regulations of India, as well as the regulations of any agency in India, without applying conflict of law principles that would require the application of any state law or regulation other than of Chandigarh. In the event of disputes between the parties, they agree to submit and consent to the exclusive jurisdiction and venue of the courts of India, and the parties waive any claims that such jurisdiction or venue is improper or inconvenient. Both parties agree to waive their right to a jury trial in any legal action arising from these Terms, and the prevailing party in such a dispute shall be entitled to recover all costs and expenses, including attorney’s fees, from the other party. Despite any jurisdiction or venue limitations, the party who is awarded a judgment under these Terms shall have the right to enforce the judgment in any jurisdiction or venue.
